Terms of Use

The Terms and Conditions here stated govern your use of DingDingShirts.com (the “Site”). The services provided by DingDingShirts.com allow Customers to design and purchase custom apparel. By using the DingDingShirts.com website and its services, you (the “CUSTOMER” / “USER”) agree to follow and be bound to these terms.

DingDingShirts.com reserves the right to change the terms and conditions that govern your use of its site and services, as we deem necessary. Use of the Site following these revisions indicates your agreement to the rules and regulations set forth by the changes.

DingDingShirts.com may add to, delete, change, or move any segment of the site including but not limited to content (i.e., products, designs, clip art) as well as equipment or software needed to access the Site. Such modifications are effective immediately, unless otherwise noted. Your use of the Site and its services after such changes are made specifies your consent to these amendments.


Intellectual Property Policy

DingDingShirts.com is committed to the protection of intellectual property and holds its Customers to the same standard. All materials, including but not limited to artwork, designs, images, illustrations, icons, and photographs featured on DingDingShirts.com are intellectual properties owned, controlled, or licensed by DingDingShirts.com.

Products created using graphics, images, and artwork provided on the DingDingShirts.com website are not to be resold commercially. Designs created using the clip art, text tools, and other graphics available on the Site are NOT the exclusive property of the Customer(s) who compiles said designs. DingDingShirts.com retains the right to offer such designs, and variances thereof, to other Customers.

In using the Site and its services, you guarantee to DingDingShirts.com that you have the right to use, copy, and distribute each copyright, trademark, service mark, trade name, logo, statement, graphic, artwork, name, photograph, portrait, picture or illusion of any person, or any other intellectual property in the way it is to be printed on or otherwise applied to merchandise ordered or purchased by you from DingDingShirts.com. You warrant that in obtaining the entity and submitting it to DingDingShirts.com for reproduction, you have not violated the property rights of any third party.

You are solely responsible for determining that any material you submit to DingDingShirts.com is not protected by copyright, trademark, service mark, or any other proprietary right. You are accountable for obtaining proper authorization and licensing, except as may be permitted by copyright law, from third parties whose rights may be violated or infringed upon by the use of any material protected by proprietary rights. You may not use any logo, image, and/or other graphics in such a way that would infringe upon any proprietary marks. You also may not use any logo and/or trademark in a vulgar, libelous, defamatory, disparaging, or otherwise unlawful manner. DingDingShirts.com assumes no responsibility for any damages or wrongdoings on the part of the Customer when using any logo, trademark, or copyrighted material.


Accuracy of Colors

The colors of the graphics (i.e., designs, clip art) and products featured on DingDingShirts.com have been displayed as accurately as possible. We cannot, however, guarantee the accuracy of the colors and/or graphics displayed by your monitor. The colors you see will depend on your monitor and may vary slightly from the actual colors of the products and/or graphics. As such, the colors displayed on the Site are for reference only. We hold no liability for damages, return of goods for refunds, credit or otherwise, as a result of any variances between the appearance of colors and/or graphics displayed by your monitor and on any finished product(s) purchased by you from DingDingShirts.com.


Privacy Policy

DingDingShirts.com respects its Customers’ right to privacy. The information we collect from you may be used in one of the following ways: to process your order transaction; to solicit your feedback in order to improve Customer service and better respond to your individual needs; and/or to email you information and updates pertaining to your order.

DingDingShirts.com offers the use of a secure server. All supplied confidential/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway database only to be accessible by those authorized with special access rights.

We do not sell, trade, or transfer your personally identifiable information to outside parties. This does not include trusted third parties who assist us in operating the Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect rights, property, or safety.

By using the Site and its services, you consent to our privacy policy.


Return/Exchange Policy

DingDingShirts.com goes to great lengths to ensure that all orders are accurate, and we strive to exceed your expectations by delivering quality products.

We must be notified of print problems within seven (7) days of your receipt of the merchandise.  We will be happy to accept goods returned for refund or replacement at no additional cost to you only if the goods demonstrate a visible fault in the garment or print (i.e., the blank garment itself is materially flawed; the print quality is below reasonable expectations; or the design of the final product is materially different from the design submitted by the Customer).  Every item is custom printed, and we cannot accept returns on the basis of incorrect sizing, errors (i.e., artwork, text, etc.), and/or omissions on the side of the Customer.  Please choose your size(s) carefully, and review you order before final submission. Note that colors may not match exactly as they appear on your screen.

Since we deal with Customer’s supplied images, it is the responsibility of the Customer to make certain that images are provided in the right format, quality, and final print size. Poor image quality does not qualify for refunds. 

All authorized refunds and/or replacements will not be issued until the entire order in question is returned in its original condition (i.e., unworn and unwashed). Authorized orders for return/exchange must be returned in their entirety within seven (7) days once authorization is granted; orders received after this seven-day window void the authorization.

Any returns will not receive credit on shipping and handling charges.  Any refunds will be credited back to the original source of payment for the order.


Disclaimer of Liability

You acknowledge that your use of DingDingShirts.com is exclusively at your risk. The Site is not warranted to be error-free or uninterrupted, and there is no guarantee as to the results obtained through use of the Site. DingDingShirts.com and all of its contents, including text, graphics, artwork, links, and other materials are provided on an “as is”/”as available” basis. The accuracy and entirety of such content is not warranted; DingDingShirts.com explicitly repudiates any liability for errors and/or omissions in said content and offers no warranty of any kind, whether expressed, implied, or statutory, including but not limited to warranties of title, merchantability, non-infringement of third party rights, and/or fitness for a specific reason. In your use of DingDingShirts.com, you also assume full responsibility for all costs, including those associated with any servicing or repairs, in your use of the Site. DingDingShirts.com is not liable for any damages related to your use of the Site.

DingDingShirts.com does not, under any circumstances, alter or make changes to any artwork and/or designs submitted by the Customer for reproduction. DingDingShirts.com is not liable for any errors (i.e., misspells, artwork, etc.) on the part of the User. All designs are printed exactly as submitted by the Customer.

DingDingShirts.com shall only be responsible for acting upon those instructions sent to and received by DingDingShirts.com and is not accountable for any communicative malfunctions not within its jurisdiction that may affect the correctness and timeliness of any orders you submit. DingDingShirts.com is not responsible for any losses and/or delays in the transmission of orders due to the use of any Internet Service Provider, including but not limited to any issues relating to browser software, computer viruses, and/or Trojans. DingDingShirts.com is not liable for incorrect information you provide or if your credit card payment is not processed by your credit card provider.

DingDingShirts.com shall, under no circumstances, be held accountable for any losses, expenses, and/or damages, whether direct or indirect, incidental or consequential, special, or otherwise, resulting from the use or incapacity to use DingDingShirts.com, or in correlation with any errors, omissions, interruptions, defects, delays in operation and/or transmission, or other failures of performance, regardless of whether DingDingShirts.com is advised of such possibilities. DingDingShirts.com is not liable for the unauthorized access of your transmission facilities, premises, and/or equipment by any third parties, or for the unlawful access to and/or modification, theft, loss, or obliteration of user accounts, data files, programs, applications, and/or systems by accident, fraudulent means, or any other methods.

The limits of liability here stated apply regardless of the form of action, whether in contract, warranty, strict liability, or tort; shall survive failure of an exclusive remedy; and will endure any and all sales completed with you, as well as any and all revisions made to these Terms and/or the Site.


Indemnity

You agree to indemnify and hold DingDingShirts.com and its owners and affiliates harmless from and against any and all suits, demands, claims, damages, losses, costs, expenses, and liabilities made against DingDingShirts.com that may arise from or are related to your use of DingDingShirts.com; your violation of these terms; your violation of any rights of another; and/or your unauthorized, improper, and illegal use of any logo, trademark, or copyright that is printed on or otherwise applied to merchandise ordered or purchased through DingDingShirts.com, and you agree to compensate any and all judgments and/or settlements offered resulting from any suit, demand, or claim, including attorney’s fees, that may be incurred by DingDingShirts.com in defending against any such suit, demand, or claim.


Legal Compliance

You shall use DingDingShirts.com for lawful purposes only. DingDingShirts.com reserves the right, in its sole discretion, to reject any order(s) considered obscene, profane, libelous, and defamatory, and/or terminate your access to the website and its services. You agree to not use DingDingShirts.com and its services to create material that is unlawful; hateful; threatening; vulgar; invasive of privacy and publicity rights; racially, ethnically, or otherwise offensive; that infringes on the proprietary rights of any third party; or that is otherwise objectionable and endorses conduct that would constitute a criminal offense or violate any law.

Governing Law

The Site is created, controlled, and maintained under the legal trade name of DingDingShirts.com in the State of California. The terms, conditions, and disclaimers on the Site, including those here stated, shall be governed by the laws of the State of California and, where applicable, by federal law.
